Dealing With Australian Police
After every weekend we all hear stories from our mates about how the police stopped them on the way home from a night out and asked them all sorts of questions about who they are and what they are doing. If your mates simply knew their rights they could have reduced the amount of information they thought they had to supply.
Most often the police will ask for your name, address and date of birth, do you need to supply this information?
You only need to supply your name and address you do not have to give your birth date. You can then ask the officer questioning you for his/her details, the officer must provide you with his/her name, rank, station and number. You have the right to not answer any further questions they ask you, it’s advised you reply with “no comment” as this indicates you are not being disrespectful and you know your rights.
Do you have to go with them when they request it?
NO! unless you are under arrest or a further breath/drug test is needed.
How do I deal with the police arresting me?
If the police wish to arrest you they must have either reasonable grounds to believe you have broken the law or a warrant. They must tell you at the time of the arrest why you are being arrested. Once they have taken you back to the station they must caution you by reading your rights about questioning and evidence. You have the right to a phone call to a friend or family and a phone call to your legal representation.
